What's the statute of limitations on a federal misdemeanor? Even if it hasn't run, there's always the issue of proof. I would think it's far easier to prove beyond a reasonable doubt that any given illegal is in the U.S. illegally now than it is to prove that they violated 8 U.S.C. § 1325(a) at some point in the past.
